Terms of Service for iOS Application
By downloading, installing, accessing, or using GPS Speedometer Premium, the user agrees to be bound by these Terms of Service. If you do not agree to these Terms, do not install or use the Software, and delete it immediately from all devices.
"DEVELOPER" refers to Nclear PROJECT, the creator and publisher of GPS Speedometer Premium.
"SOFTWARE", "APP", or "SPEEDOMETER PREMIUM" refers to the GPS Speedometer Premium mobile application for iOS.
"USER" refers to any individual or entity downloading, accessing, or using the Software.
The Software is provided for auxiliary convenience and informational purposes only. It is not designed, certified, or intended for use in critical navigation, emergency operations, or official law-enforcement speed verification. The vehicle manufacturer's factory-installed dashboard instruments and official road signs must always take precedence over readings displayed by the App.
Speed, distance, heading, altitude, and coordinate calculations rely on satellite GPS signals and the device's built-in sensors. It is acknowledged that:

The App includes configurable speed threshold alerts (visual flashing and audio cues). These alerts are an auxiliary aid and should not be solely relied upon to prevent overspeeding. The Developer does not guarantee that alerts will be audible by the User under all circumstances (such as when device volume is low or muted).
When using the Head-Up Display (HUD) mirrored mode or placing a device inside a vehicle:
Prolonged display of high-contrast static elements on mobile screens (particularly OLED and AMOLED panels) is vulnerable to inherent hardware pixel degradation and image retention ("burn-in"). This is caused by a hardware limitation, and is not an app-related issue.
User privacy is of utmost importance. The Software processes all GPS, motion, and sensor computations locally on the device without transmitting data to external servers or third-party trackers. Please review the complete Privacy Policy for full details on data handling practices.
All code, graphics, user interface designs, and branding in GPS Speedometer Premium are the proprietary property of Nclear PROJECT.
Third-party components, including digital fonts and open-source assets, are used under their respective open-source or proprietary licenses and are fully credited in the Licenses section within the App's settings.
Your use of this application is also governed by Apple's Standard Licensed Application End User License Agreement (EULA). In the event of any conflict between these Terms and the Standard EULA, the Standard EULA shall prevail regarding your license to use the application.
While reliability and meticulousness are top priorities in development, no guarantees are made regarding performance or fitness for any particular purpose. Use this app at your own risk.
The app may be updated at any time. As such, uninterrupted access or error-free operation is not guaranteed. If you encounter a software bug or unexpected behavior, you are encouraged to contact the developer to help resolve the issue.
THE SOFTWARE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.
THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT SPEED, DISTANCE, OR SENSOR CALCULATIONS WILL BE 100% ACCURATE OR COMPLETE AT ALL TIMES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NCLEAR PROJECT, ITS DEVELOPERS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR TRAFFIC TICKETS, SPEEDING FINES, MOVING VIOLATIONS, VEHICULAR ACCIDENTS, COLLISION DAMAGE, PERSONAL INJURY, BODILY HARM, LOSS OF LIFE, PROPERTY DAMAGE, HARDWARE WEAR, SCREEN BURN-IN, OR LOSS OF DATA), ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
USE OF THE SOFTWARE IS AT THE USER'S SOLE RISK.
The Software may contain links to external third-party websites. The Developer does not control and is not responsible for the content, accuracy, privacy policies, or practices of any third-party resources.
The Developer reserves the right to modify, update, or discontinue any feature of the Software at any time without prior notice.
These Terms of Service may be updated occasionally to reflect changes in software functionality or legal obligations. It is your responsibility to check this page for the latest version. The date of the most recent revision is displayed at the top of this document. The latest version remains accessible via the Terms of Service button in the application settings and on the official website.
Continued use of GPS Speedometer Premium signifies agreement to the terms of these Terms of Service.
Governing Law: These Terms of Service and any dispute arising out of or in connection with the Software shall be governed by, interpreted, and enforced in accordance with the laws of Poland, without regard to its conflict of law principles. Any legal actions or proceedings related to the Software shall be brought exclusively before the competent courts of Poland.
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
